Divorce Attorney Scott Ellerin explains how property is divided between you and your former spouse.
Florida is what is known as an equitable distribution. What that means is that Florida wants to equitably divide and distribute the marital assets and liabilities, distribute them fairly or evenly. What happens is Florida takes the window of time—the date the parties were married until the date that the parties filed for divorce or entered into a valid separation agreement – and all the assets and liabilities that fall within this window are to be equitably distributed by the court. |
