What Happens to the Marital Home during Divorce?
Posted By Ellerin Hutchinson

When it comes to your marital home in a divorce settlement, equitable distribution is a term that you will be hearing a lot.

If you don't decide to sell your home then there are three factors that can determine whether you will get a credit for or a set-off against the value of the home. The first is who will inhabit the home, or who gets full possession of the house, and the basis of that award by a judge. Secondly, if the spouse who is already receiving alimony or child support gets possession of the home as well, you must look at whether the alimony payments will be used for taxes, mortgages payments and other home-related items. Finally, the value of the home.

By examining these factors a court can also look at whether the parties will be claiming capital gains, home related tax deductions and other relevant factors that can affect their right to a set off against their marital portion or a credit. However, since every divorce situation is unique, there is no clear formula that judges use to make this decision. While the liabilities and property of distribution of assets in a divorce they can achieve a degree of consistency by using the above factors to make a decision.

If you have questions about equitable distribution, contact us to get answers from a Jacksonville family law attorney.

Justin Bieber Involved in The Dream's Divorce
Posted By Ellerin Hutchinson

Another Hollywood couple that has been in the press lately for their divorce, Christina Milian and the Dream, have taken their divorce to a new level. The Dream, who had agreed to pay Milian 10% of his publishing rights for Justin Bieber's hit song "Baby" is angry that his wife is demanding a bigger portion of the pot.

In addition to asking forspousal support Milian wants a larger percentage of the money that The Dream is getting from Bieber's rising fame. As they fight over this latest financial agreement he has stopped making any payments to Milian while their lawyers duke it out for them.

Milian's lawyer recently told TMZ that, "Mr. Nash filed for divorce. He wanted the divorce, not our client. She then agreed to resolve it peacefully and outside of court." Yet his lawyers are backing down from her peaceful attempts to ensure that any agreements they make are completely on record, taking away any chance of resolving this divorce out of the court room.

If you believe that you should be asking for more money from your divorce settlement, or you want to fight the amount that your spouse is demanding, you need a Jacksonville divorce lawyer on your side.  Don't hesitate to contact Ellerin Hutchinson to get the legal help you need.

  Study Links Suicide and Divorce
Posted By Ellerin Hutchinson

Men whose parents were divorced before they turned 18 are two to three times more likely to seriously consider suicide, according to a new study conducted by Dr. Fuller-Thomson.

However, women whose parents divorced before that same age were not as affected. They were also plagued by increased thoughts of suicide but they were more often linked to other traumatic events. Conducted at the University of Toronto, the study reveals that since children are more likely to be taken into custody by their mothers, the reduced contact with a male role model could be significant in the way men thought later on in life. Fuller-Thomson adds that "other research has indicated a positive father figure is very important for young men and boys, to develop their gender identity and learn ways to regulate their emotions and enhance their mental health."

It is important to add that thought of suicide only affected a small amount of those in the study, and that parents considering divorce now shouldn't take this research to mean that that their children could be at risk.

Eddie Murphy's Ex Blows Through Alimony
Posted By Ellerin Hutchinson

Although a check for $15 million would make nearly anyone feel happy, it is not the case for Eddie Murphy's ex-wife Nicole Murphy. When the two they divorced four years ago after 13 years of marriage, Nicole opted to have a one-time payout of $15 million instead of monthly alimony payments.

At this time she owes $5 million on her house and her landscaping company $60,000. At this point the money in her account is dwindling quickly.

If you are debating whether to ask for alimony from your spouse or take a one-time lump settlement for your divorce, you need tocontact a Jacksonville family law attorney to help you make this important decision.

  Christie Brinkley Speaks About Divorce
Posted By Ellerin Hutchinson

Unlike other stars who rush back into finding love after divorce, Christie Brinkley has gone two years so far without actively perusing the market. She cites always having her children with her as one reason why people may not approach her romantically, also that "you never know if someone is talking to you because you're a celebrity. It's not my number one priority."

At this time she has given priority to being a mother which she claims has always been a part of her life plan. She has three children - Alexa Ray, 25, Jack, 15, and Sailor, 12. Brinkley claims that her work schedule allows her to be a better mom that "it gives me a little door to step out of my parenting and bring the excitement from that day back home."

Although her divorce from ex-husband Peter Cook was extremely painful, she was able to get through this period by keeping laughter in her life.

Study Suggests Education Level Impact Divorce Rate
Posted By Ellerin Hutchinson

A recent study by the National Marriage Project reveals that the "moderately educated" are getting married less and divorced more. The study, conducted by the University of Virginia and the Center for Marriage and Families at the Institute of American Values, shows that among those who have a high school diploma but do not have a college degree, marriage and divorce values are changing.

While the "moderately educated" have traditionally been more conservative and traditional in regards to family and marital matters, they "now appear to be turning more socially permissive, even as highly educated Americans have been more likely to embrace a marriage-minded mindset" the study reveals.

Additionally, the study also found that of 25 to 60-year-olds with college degrees, 34 percent go to church on a regular basis, while only 28 percent of the moderately educated and 23 percent of the "least educated" do so.

Are you considering divorce? If so, you should consider consulting with a Jacksonville divorce lawyer first before making this serious decision. Contact Ellerin Hutchinson now!

Tony Parker Files Divorce Petition after Eva Longoria Filed Hers
Posted By Ellerin Hutchinson

Just two days after actress Eva Longoria filed her divorce papers in California, husband Tony Parker did the same in Texas. The couple, who have been married for three years, are saying that "discord or conflict of personalities" is the reason why they are divorcing one another.

While it could be seen as an aggressive move, Parker's separate filing is "standard procedure" and is merely an attempt to protect his rights as well in the divorce process. A source revealed to People magazine that the couple "are still committed to working this out together amicably." Parker's separate filing is supposed to be due to the fact that Longoria found hundreds of text messages from another woman on his phone. The woman is believed to be the wife of Brent Barry, Parker's former teammate.

Although she is not commenting on whether the above rumor is true, Longoria has gone public with her divorce, stating that "we love each other deeply and pray for each other's happiness."

  Beyonce's Parents Reconcile
Posted By Ellerin Hutchinson

Despite initial reports that Beyonce's mother, Tina Knowles, filed fordivorce about a year ago, new circumstances reveal that perhaps the pair are having second thoughts. Tina and Mathew, Beyonce's father, were scheduled to have a court appearance last week in Harris County, Texas. However, neither party showed up at the courthouse, causing the judge to dismiss the case.

After 29 years of marriage Tina filed for divorce after her husband was hit with a paternity test last year. The woman, Alexsandra Wright, claimed that Mathew was the father of her unborn child. A test would later prove that, indeed, Mathew is the father. Neither party has commented as to whether this event is the primary reason behind their divorce.

Tina is one of the principle designers at the House of Dereon, the fashion empire she co-created with Beyonce. Her husband left his long-time job with IBM to manage Beyonce during the beginning of her singing career, into the creation of Destiny's Child, and beyond. He is the founder of Music World Entertainment that has managed the careers of Solange Knowles, Sunshine Anderson, Kelly Rowland, and Michelle Williams.

Camille Shocked by Divorce from Kelsey Grammar
Posted By Ellerin Hutchinson

Camille Grammar was shocked when husband of 13 years, Kelsey Grammar, recently filed for divorce. When Camille agreed to become a cast member of Bravo's new show "The Real Housewives of Beverly Hills" their marriage seemed to be on firm ground. However, as the show started filming, Kelsey not only filed for divorce but shortly after went public with his 29 year old girlfriend Katye Walsh.

Camille believes that Grammar wanted her to sign on with Bravo's show in order to make his relationship with Walsh easier. By distracting her and keeping her on the west coast, Kelsey had already moved to New York City to star in La Cage Aux Folles, a Broadway revival play. Furthermore, she didn't really want to do the show, stating "I think it was more Kelsey's agenda. I was very reluctant, because I am a very private person."

Despite the anger that Camille is feeling now, she expressed a desire to once again become friendly with Grammar, the father of their two children. Yet she is not pleased that the details of their divorce will be played throughout the new season of the Housewives of Beverly Hills.

  Communicating with Your Divorce Lawyer
Posted By Ellerin Hutchinson

It is important to establish a work relationship with your divorce lawyer if you are to make the most out of his/her counsel. One common complaint that clients have is their inability to reach their lawyer. Most likely your lawyer is at court or with another client, however, you should always leave a message with the legal assistant or secretary. A telephone conference or office visit can be scheduled with your lawyer; if you continue to have difficulties, ask him/her about additional methods of communication that might be more effective.

As each meeting is vital to your case and may be brief due to your lawyer's hectic schedule, it is vital that you discuss all relevant issues regarding your case, even if you feel that they might be embarrassing. Your lawyer cannot be completely effective in helping you win your case in court if he/she does not know all of the details beforehand.

It is worse for legal counsel to be surprised at trial because they did not have the relevant facts than for you to experience slight embarrassment in the confines of your lawyer's office.

If you are going through a divorce, contact us to get help from a Jacksonville divorce lawyer.

  New York Approves No-Fault Divorce
Posted By Ellerin Hutchinson

New York has finally agreed to allow marital unions to end in no-fault divorce.  It is the last state in the country to allow no-fault divorce as justifiable grounds for termination of marriage.

While many are happy to hear the news, others have nothing but complaints about the recent change in family law.  Dennis Poust of the New York State Catholic Conference said, "By saying there's this concept of no fault divorce, it really cheapens the institution of marriage."

Poust stood before lawmakers and testified against the bill before it was approved in early 2010. He truly believes that the way divorce was handled prior to the law change in New York was much better.  He said, "We have grounds for divorce in the state, adultery, abuse, abandonment. If a marriage is broken and after a cooling off period of one year, then you have the so-called no-fault divorce."

Instead, Poust has gone on record to say that New York should promote policies that strengthen marriages.  He even went so far as to say that a marriage should be tougher to break down a cell phone contract and believes that with therapy and marital counseling marriages can be saved.

If you need help with your divorce, contact our legal team to get assistance from a Jacksonville divorce attorney.
