Tennessee Simplifies Uncontested Divorces
In order to simplify the divorce process, the state of Tennessee will be enacting new legislation to speed up the process for those who qualify.
For those couples that are seeking a divorce that do not have pension plans or minor children, they will be able to file without lawyers. The state Supreme Court has devised a "plain language" form that should allow most people to understand how to file for divorce on their own. This will only apply to no-contest divorces in which neither party has any objection to the termination of the marriage.
These forms were designed to allow people greater access to justice, especially those who cannot afford legal help. The plain language forms are available to any couples who have no dispute about ending their marriage, do not have children together, don't own land or buildings together and cannot claim retirement benefits. Additionally, the wife must not be pregnant if the couple wishes to use the plain language form.
